Historically, most car dealers that offered finance did so on the basis that the finance company gave the dealer a percentage commission on each car that was financed through them.

Where a commission was paid, this was in the vast majority of cases not declared to the customer.

Recently, this situation was challenged, and the High Court ruled that the price of the car and any commission on the financing of the car received by the dealer were separate products, and needed to treated and declared as such.

The implications of this ruling are potentially widespread, and comparisons have been made to the mis-selling, and compensation claims regarding other financial products. In the short term some lenders have stopped car finance until the situation becomes clearer.
